Queens Consumer Protection Lawyer

Queens Consumer Protection Attorney

Consumer law, both state and federal, protects you and protects the marketplace from unscrupulous businesses, predatory lenders, overzealous debt collectors, careless credit bureaus, consumer scams and other harmful business practices.

David Kasell has been a powerful and effective advocate for consumer rights for over a decade, with extensive knowledge of and experience handling the following areas of consumer protection law.

Lemon Law. Under state and federal law, car buyers have a right to refund or replacement when the vehicle fails to meet standards of quality and performance.

Undisclosed Vehicle Accident Histories. Countless numbers of vehicles are sold each year without accurately or honestly disclosing previous accident histories. When a dealer sells a car that it knows or should have known was damaged in an accident, consumers are harmed – egregiously.

Financing Fraud and Deceptive Lending Practices. Consumers have a powerful tool in the Truth in Lending Act that protects against deceptive loans and lending practices. If you have an equity line of credit, a credit card, a mortgage or an auto loan, for example, the Truth in Lending Act protects you. However, fraud claims and others must be brought within the one-year statute of limitations or your right to recover could be lost.

Illegal Debt Collection Practices. The federal Fair Debt Collection Practices Act is the law that protects consumers from a wide range of abusive conduct, including failure to respect privacy. If you suspect that a debt collector is using illegal means to collect a debt, take action.

False and Improper Reporting of Credit Issues and Histories. Consumers use credit to pay for education or a house, a car, or to finance a loan to keep their business operating, and frequently employers check credit history before they hire. Your credit history is invaluable. Under the Fair Credit Reporting Act (FCRA), consumers have the right to know what is in their credit file and the right to dispute incomplete or inaccurate information.
