New York Lemon Law Cases

New York's lemon law was enacted in 1983 and protects car buyers and lessors of both new and used cars. Kasell Law Firm has handled hundreds of New York lemon law cases against nearly every major car manufacturer.

Consumer Protection Law For New Cars

New York new car lemon law applies to passenger vehicles driven primarily for personal use and under the umbrella of the manufacturer's warranty. If the car fails to perform as it should and the dealer or sales agent is unable to repair the defect after four attempts or the car has been out of service for repairs for a total of 30 days or more, the car meets the law's qualifications. Under New York's lemon law, you are entitled to:

  • A refund of the purchase price, plus license and registration fees, minus a mileage allowance if the car has been driven more than 12,000 miles, or
  • A comparable replacement car

If your new car does not qualify under state lemon law, there are still options to pursue under federal law.

Used Car Lemon Law In New York

New York law requires dealers to provide written warranties on used cars selling for $1,500 or more, with mileage of less than 100,000 miles. Under this warranty, dealers must repair, free of charge, any defect in covered parts.

If the dealer is unable to repair the car after a reasonable number of attempts, the consumer is entitled to a full refund or replacement. The duration of warranty on a used car — 30, 60 or 90 days — depends upon the mileage on the vehicle and applies only up to 100,000 miles.
